OFFICIAL CONTEST RULES

1. NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

2. Eligibility. The parent or legal guardian of any child between the ages of six (6 ) and thirteen (13) at time of entry may enter their child in The Glen Ellyn Moms: A Cut Above Contest (the “Contest”). The children must be residents of Glen Ellyn or attend school in School Districts 41 or 89 or at a private school located within the village limits of Glen Ellyn. Children of employees of Glen Ellyn News and GateHouse Media, Inc. (collectively, “GateHouse Media”), The Glen Ellyn Economic Development Corporation and each of its respective divisions, affiliated companies, subsidiaries, parent companies and advertising or promotional agencies, and the immediate family members of, and any persons domiciled with such employees, are not eligible.

3. Entry. The Contest will begin at 12:01 a.m. (C.D.T.) on April 1, 2009, and all entries must be received by 5:00 p.m. (C.D.T.) on April 24, 2009 (the “Entry Period”). Entry details are available in the Glen Ellyn News newspaper, published on April 16 and April 23, 2009, and also at mysuburbanlife.com/glenellyn. Or a PDF of the entry form will be available by visiting the www.glenellynite.com website. All entrants must complete all of the required information and follow all instructions. Entries must be hand-written or typewritten and on the official entry form. All entries must be received postmarked by April 24, 2009 or received by 5:00 p.m. (C.D.T.) at the Glen Ellyn Economic Development Corporation Office, 800 Roosevelt Road D-108, Glen Ellyn, IL 60137. Illegible, mangled or incomplete entries are void. All entries submitted shall become the property of the Glen Ellyn Economic Development Corporation and will not be acknowledged or returned. GateHouse Media and the Glen Ellyn Economic Development Corporation (collectively, the “Sponsors”) will not be responsible for late or misdirected mail, and will not be responsible for incomplete, lost, late, post-due, misdirected or illegible entries or for failure to receive entries due to transmission failures or technical failures of any kind, whether originating with entrants or the Sponsors. Any questions regarding the entries submitted shall be determined by the Sponsors in their sole discretion, and Sponsors reserve the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Contest.

All entrants and their parents or guardians hereby agree that upon their submission, the entry, any and all rights to create any derivative works using this essay and all proprietary rights therein, become the exclusive property of the Sponsors, and that the Sponsors shall have the right to reproduce the essay in full or in part, and use it and the entrant’s name, photograph, likeness and/or statements for promotional purposes, without further compensation. By entering the Contest, entrant and his/her parents or guardians represent that entrant is the author of the essay and that the essay does not infringe the proprietary right of any third party. No submissions that include any copyrighted, licensed or trademarked characters or names shall be accepted. Upon entry, each entrant and his/her parents or guardians also release GateHouse Media and the Glen Ellyn Economic Development Corporation from all liability arising from his/her entry in the Contest and agree to sign any additional documentation which the Sponsors may reasonably request addressing this or any other Contest rules. The Sponsors reserve the right to request from any entrant, additional documentation they reasonably believes is necessary to validate any entry or award any prize.

4. Judging. All entries must be written in English. The essay cannot be more than five hundred (500) words in length and must be the original work of the child entering the Contest. Approximately fifty (50%) percent of the Essay will be judged on how the mother in question has made a difference in their child’s life or community. The Essays will be judged and points will be awarded in the following manner: fifty (50%) percent will be based on how the mother in question has made a difference in their child’s life or community, twenty-five (25%) percent will be based on creativity, and twenty-five (25%) percent will be based on composition.

5. Prizes and Odds. Prizes are as follows, and will be assigned to top nine winners. In the event that nine winners are not selected, one winner may win more than one prize, at the discretion of the judges.

Odds of winning depend on the number of eligible entries received.

6. Winner Notification and Acceptance. Winners will be notified by telephone or mail in accordance with the information provided during the week of April 27, 2009, from among all eligible entries received by 5:00 p.m. (C.D.T.) on April 24, 2009. Return of prize notification as undeliverable may result in disqualification and an alternate winner may be selected. Winners may waive their right to receive prizes. Prizes are nonassignable and nontransferable. No substitutions allowed, except that prizes and individual components of prize packages are subject to availability and the Sponsors reserve the right to substitute prizes of equal or greater value. In the event of non-compliance with these Official Rules, or if a prize is refused or cannot be accepted for any reason, the prize will be forfeited and an alternate winner will be selected in a random drawing. Upon forfeiture or refusal, no compensation will be given. Winners are solely responsible for reporting and payment of any taxes on prizes. Prizes won by minors will be awarded to parent or legal guardian who must sign an Affidavit of Eligibility, Liability and Publicity Release required by the Sponsors. Except where prohibited, participation in the Contest constitutes entrant’s consent to the publication of his or her name, biographical information and likeness in any media for any commercial or promotional purpose, without limitation or further compensation. For prize winners list (available after May 15, 2009), send a self-addressed, stamped envelope to The Glen Ellyn Economic Development Corporation, 800 Roosevelt Road D-108, Glen Ellyn, IL 60137.

7. Participation. By participating, entrants agree to be bound by these Official Rules and the decisions of the judges. The Sponsors reserve the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by the Sponsors. In the event the Contest is compromised by non-authorized human intervention, tampering or other causes beyond the reasonable control of the Sponsors which corrupts or impairs the administration, security, fairness or proper operation of the Contest, the Sponsors reserve the right in their sole discretion to suspend, modify or terminate the Contest. Should the Contest be terminated prior to the stated expiration date, the Sponsors reserve the right to award prizes based on the entries received before the termination date.

8. Disclaimers. By entering, participants acknowledge and agree that the Sponsors and their respective corporate parents, subsidiaries, and affiliates, and the officers, employees and agents of each of them will not be liable for losses or injuries of any kind resulting from any participant’s acceptance, possession, use and/or misuse of any prize(s), travel to or from any prize-related activity, participation in the Contest, printing, mailing or distribution errors, or any malfunctions of the telephone network, or any combination thereof. Without limiting the generality of the foregoing, the Sponsors reserve the right to terminate, suspend or modify the Contest if, at its sole discretion, it determines that for any reason the Contest is not capable of running as originally planned, or fraud, technical failures, printing, mailing or distribution errors, or any other unanticipated causes or occurrences have compromised the fairness or integrity of the Contest. In the event the Contest is terminated prior to the stated end date, the Sponsors reserve the right to award all prizes in a random drawing from among all eligible entries received as of the date of termination.

9. Construction. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any contestant and the Sponsors, shall be governed by, and construed in accordance with the laws of the State of Illinois, without giving effect to any choice of law or conflict of law rules or provisions (whether of Illinois, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Illinois. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

10. General Release. By entering the Contest, the entrants release GateHouse Media, Suburban Life Newspapers and the Glen Ellyn Economic Development Corporation, any other promotional sponsors, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any and all liability whatsoever for any claims, costs, injuries, losses or damages (including attorneys’ fees) of any kind arising out of or in connection with the Contest or with the acceptance, possession or use of any prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).
11. Conditions. This Contest shall only be construed and evaluated according to the laws of the state of Illinois, without regard to the principles of conflicts of laws and submission of any entry constitutes acceptance of such laws.

12. Sponsors. The Glen Ellyn Moms: A Cut Above Contest is sponsored by GateHouse Media and the Glen Ellyn Economic Development Corporation whose decisions regarding the selection of winners and all other aspects of the Contest shall be final and binding in all respects. The Sponsors will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Contest.

Successful “Shop Glen Ellyn First” Campaign Brings Customers to Downtown

The “Shop Glen Ellyn First” campaign sponsored by the EDC is exceeding response expectations for direct mail marketing. A dining incentive was offered in two mailings sent out in early and late winter. The offer brought customers to the downtown and into 11 participating restaurants. The typical 1-2% response rate cited by Direct Mail authorities for a first time mailing was surpassed by the early winter postcard which had a 3% return. Success for follow up mailings is typically measured by a response in the range of 1-3%. The late winter “Shop Glen Ellyn First” mailing exceeded expectations again with a 4.6% response and 92 postcards presented at participating restaurants.

New Downtown Retail Grant Program for Business Recruitment

The EDC announces a new incentive program which will help attract new retailers and retain expanding retailers in the downtown. The program offers up to a 50% matching grant up to $20,000 to assist interior improvements. Coupled with the Façade Improvement Grant Program, new and expanding retailers in the downtown can receive up to $30,000 in assistance. Property owners and business owners in commercially zoned districts throughout Glen Ellyn are invited to apply. Details will be posted on the EDC website in the near future. Façade Improvement Grant Program Is Enhanced

The EDC has increased the level of assistance available through its Façade Improvement Grant Program. Approved projects can now receive up to a 50% matching grant up to $10,000. This program revision doubles both the matching percentage and the maximum funding level to accelerate desirable exterior appearance improvements. Property owners and business owners in commercially zoned districts throughout Glen Ellyn are invited to apply.
